2011-4-8 21:21:24 中国网 老人住进养老院,可以得到专业人员的护理、照顾,但养老院与老人之间产生的纠纷日渐增多,已成为社会关注的热点之一。 护理人员失职 【案例】 70岁的刘某因智力障碍痴呆,缺乏判断和自我保护能力。 2010年1月,子女将其送至一家养老院。合同约定的服务范围包括照料其饮食起居等日常生活。 同年2月9日中午,刘某需到屋外30米处上厕所,护理人员陆某看电视正在兴头上,便让刘某自己前往未陪同搀扶。刘某在上台阶时不慎摔倒,造成腰椎一椎体粉碎性骨折,构成九级伤残,发生医疗费用3.8万元,养老院以刘某摔倒是其自身行为所致为由拒绝赔偿。
